Emergent Immigration Habeas Non-transfer Order
#3
Jul 27, 2026
TEXT ORDER: The Court has reviewed the Petition for Writ of Habeas Corpus filed by Petitioner Efren Policarpo Vaca Flores. (ECF No. 1.) The Court notes that Petitioner previously filed a habeas petition challenging his detention in Vaca Flores v. Blanche, et al., Civil Action No. 2:26-cv-05446 (JKS). That matter involved the same Petitioner, the same underlying detention at Delaney Hall Detention Facility, and substantially similar challenges to the legality of Petitioner's immigration detention. The prior action was closed on June 10, 2026, following the Court's determination that Petitioner had not demonstrated that his detention pursuant to 8 U.S.C. § 1231(a) was unlawful or constitutionally impermissibly prolonged, and the Court denied Petitioner's subsequent motion for reconsideration on July 16, 2026. Accordingly, to the extent Petitioner seeks relief concerning the same detention and underlying claims raised in Civil Action No. 2:26-cv-05446 (JKS), Petitioner shall file the Petition and any related requests for relief in that action rather than proceeding under a separate civil action. The Clerk shall administratively terminate this matter. Nothing herein shall be construed as a ruling on any motion Petitioner may file in Civil Action No. 2:26-cv-05446 (JKS), including any request to reopen that matter or otherwise seek relief based on changed circumstances. So Ordered by Judge Jamel K. Semper on 7/27/2026. (sms) (Entered: 07/27/2026)
