TEXT ORDER - The Court has reviewed the Petition for a Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241 filed by Petitioner Fredy Geovanny Tacuri Pulla ("Petitioner"), a native and citizen of Ecuador, who is currently detained at the Delaney Hall Detention Facility in Newark, New Jersey. (ECF No. 1.) Petitioner alleges that on July 20, 2026 he was unlawfully arrested by United States Immigration and Customs Enforcement ("ICE") without a valid warrant, individualized suspicion, or a lawful custody determination. Petitioner further contends that ICE relied on altered or post hoc paperwork to justify his arrest, engaged in racial profiling, failed to consider his family ties and pending pursuit of U- nonimmigrant status as a crime victim, and violated his statutory and constitutional rights under the Fourth and Fifth Amendments. (Id.) Accordingly, it is ORDERED that Respondents shall SHOW CAUSE, within seven (7) days of the entry of this Order, why the Petition (ECF No. 1) should not be granted, and shall file with their response all portions of the administrative record necessary for the Court's review. Petitioner may file a reply within three (3) days after service of Respondents' response. Respondents shall not transfer Petitioner outside the District of New Jersey during the pendency of these proceedings. In light of the relief granted, Petitioner's Motion for Temporary Restraining Order (ECF No. 2) is DENIED. So Ordered by Judge Karen M. Williams on July 22, 2026.
