ORDER by Judge Derrick K. Watson. On July 21, 2026, Petitioner Manuel de Jesus Enamorado Sayadera, proceeding with counsel, filed a petition for writ of habeas corpus, seeking, inter alia, his release from custody. Dkt. No. 1. Pursuant to General Order 26-05, the Court set a briefing schedule on the petition for writ of habeas corpus, requiring an answer by July 28, 2026, and a reply within three days thereafter. Dkt. No. 6. On the same day, Petitioner moved for a temporary restraining order ("TRO"), seeking his immediate release pending resolution of the habeas petition or, alternatively, a custody hearing within 7 days. Dkt. No. 3. Upon review of the habeas petition, the TRO motion, and the material attached thereto, Petitioner has not shown that a temporary restraining order should issue before the government can be heard in opposition, as required under Federal Rule of Civil Procedure 65(b)(1). Specifically, the Court does not believe that the harm Petitioner alleges namely, his continued detention is sufficiently extraordinary as to justify the relief he seeks. See Wang v. Warden of Desert View Annex Det. Facility, No. 26-CV-01595 (DFM), 2026 WL 931095, at *1 (C.D. Cal. Apr. 2, 2026) ("If the generalized harm of detention were sufficient to bypass the standard briefing schedule, nearly every immigration habeas petition filed in this District would warrant an emergency TRO."). Accordingly, the TRO motion 3 is DENIED WITHOUT PREJUDICE. IT IS SO ORDERED. (iv) (Entered: 07/22/2026)
