Stearns: ELECTRONIC ORDER entered re 7 Response to Petition for Writ of Habeas Corpus - 2241 filed by U.S. Department of Homeland Security, Markwayne Mullin, Executive Office for Immigration Review, Todd Blanche, Joseph D. McDonald. Petitioner Denis Alexander Villanueva Guevara is a citizen of El Salvador residing in Massachusetts. He was arrested on his way home from work on the night of July 14, 2026, by Enforcement and Removal Operations officers from the United States Department of Homeland Security. Producing a driver's license, he was released at a court hearing the following day, but re-arrested by United States Immigration and Customs Enforcement (ICE) outside the courthouse. He is currently detained at the Plymouth County House of Correction.The court agrees with Petitioner that he is entitled to a bond hearing. The government must arrange a bond hearing for Denis Alexander Villanueva Guevara before an Immigration Judge (consistent with the standards outlined in Hernandez-Lara v. Lyons, 10 F.4th 19 (1st Cir. 2021)), as soon as practicable, but in no case later than Friday July 31, 2026.
