** TEXT ONLY ORDER ** Petitioner Jaspreet Singh, a non-citizen currently in custody of Immigration and Customs Enforcement, contends that respondents have unlawfully detained him without an opportunity for a bond hearing under 8 U.S.C. § 1226(a), while the Department of Homeland Security appeals an order granting petitioner leave to voluntarily depart the United States. The petition presents an issue similar to the once raised in Quinapanta v. Bondi, Case No. 25-cv-795-wmc (W.D. Wis.)(dkt. #18), in which this court concluded that immigration officials had unlawfully classified the petitioner as ineligible for bond under 8 U.S.C. § 1225(b)(2). See also Paredes Padilla v. Galovich, Case No. 25-cv-863-jdp (W.D. Wis.)(dkt. # 19 ) (reaching the same conclusion); and Castanon-Nava v. U.S. Dep't of Homeland Security, 161 F.3d 1048, 1061 (7th Cir. 2025). Because petitioner is represented by counsel, he is directed to submit summonses which the clerk of court will issue upon receipt. Petitioner should promptly serve respondents with the petition and this order. Within ten days after petitioner files his certificate of service, respondents are ORDERED to show cause why the petition should not be granted. Given the difficulties the court has experienced in previous cases with multiple transfers, respondents are further ORDERED to refrain from removing petitioner from the Western District of Wisconsin during the pendency of this proceeding. In their response brief, respondents shall identify any factual circumstances that distinguish this case from Quinapanta. Signed by District Judge William M. Conley on 7/21/2026.
