TEXT ORDER This matter comes before the Court upon Petitioner's Petition for Writ of Habeas Corpus, Dkt. No. 1 ("Petition"). Petitioner challenges her immigration detention as unlawful. In accordance with Rule 4 of the Rules Governing 2254 Cases ("Habeas Rule 4"), applicable to § 2241 cases through Rule 1(b), scope of the Rules, this Court has screened the Petition for dismissal and determined dismissal without a full answer is not warranted. Respondents shall file an expedited answer to the Petition within seven (7) days. Petitioner may file a reply to the answer within three (3) days. TEXT ORDER This matter comes before the Court upon Petitioner's petition for writ of habeas corpus under 28 U.S.C. § 2241 (Dkt. No. 1, Petition), Respondents' answer in opposition (Dkt. No. 5, Answer) and Petitioner's reply brief (Dkt. No. 6, Reply). This issue is whether Petitioner, having pled a burglary charge down to trespass and having a theft charged dismissed, may no longer be detained under the Laken-Riley Act, 8 U.S.C. § 1226(c)(1)(E), and if not, whether Petitioner is detained under 8 U.S.C. § 1226(a), which requires she be provided a bond hearing. Accordingly, it is ORDERED that Respondents shall either: (1)provide Petitioner with a bond hearing pursuant to 8 U.S.C. § 1226(a) within seven (7) days of this Order; or (2) file a supplemental brief, no more than ten (10) pages, within 21 days of this Order, addressing the legal effect of the June 22, 2026 dismissal/downgrade of charges relevant to application of the Laken Riley Act, 8 U.S.C. § 1226(c)(1)(E), and Petitioner's as-applied due-process challenges to the Laken Riley Act.
