ORDER: The Court recognizes that developments in a habeas petitioner's custody or immigration proceedings may affect the Court's consideration of the petition or render the petition moot. To ensure that the Court receives timely notice of such developments, the Court hereby ORDERS as follows: 1. Continuing Notification Requirement. Pursuant to 8 C.F.R. §§ 1003.19(g) and 236.1(f), DHS is already required to notify the immigration court immediately of certain changes in a noncitizen's custody status or location. During the pendency of this action, Respondents shall contemporaneously notify this Court of any such change, including the Petitioner's transfer to another detention facility or release from custody. Respondents shall also promptly notify this Court of any other material development affecting the Petitioner's detention or immigration proceedings, including any custody redetermination, grant of voluntary departure, issuance or finality of a removal order, or scheduled or actual departure from the United States. Such notice shall be filed as soon as practicable and, absent good cause, no later than two business days after the event. 2. Initial Status Report. Within five business days of entry of this Order, Respondents shall file a status report identifying the Petitioner's current custody status and location, and any material developments in the Petitioner's immigration proceedings since Respondents' most recent filing, including any of the events identified above. 3. Communication with DHS/ICE. Counsel for Respondents shall communicate these requirements to the appropriate DHS/ICE officials to ensure timely notification. The duty to provide status updates shall continue until final disposition of the habeas action. Signed by Judge Stephanie L. Haines on 11/6/26. Text-only entry; no PDF document will issue. This text-only entry constitutes the Order of the Court or Notice on the matter. (al) (Entered: 11/06/2026)
