ORDER by Judge Derrick K. Watson. On July 15, 2026, Petitioner L.I., proceeding with counsel, filed a petition for writ of habeas corpus, seeking, inter alia, his release from custody. Dkt. No. 1. On July 16, 2026, pursuant to General Order 26-05, the Court set a briefing schedule on the petition for writ of habeas corpus, requiring an answer by July 23, 2026, and a reply within three days thereafter. Dkt. No. 6. On July 20, 2026, L.I. moved for a temporary restraining order, seeking his immediate release pending resolution of the habeas petition (TRO motion). Dkt. No. 12. At the same time, L.I. also moved for leave to file the TRO motion under seal (seal motion). Dkt. No. 10. Upon review of the habeas petition, the TRO motion, and the material attached thereto, L.I. has not shown that a temporary restraining order should issue before the government can be heard in opposition, as required under Federal Rule of Civil Procedure 65(b)(1). Specifically, given the extraordinary nature of the relief L.I. appears to request, the Court is unconvinced that he has sufficiently shown a "rapid deterioration" in the medical condition to which he refers, the "similar[ity]" of his present detention to ones in his past, a threat to his safety, or the "inadequa[cy]" of his medical care. See Winter v. Nat. Res. Def. Council, Inc., 555 U.S. 7, 20 (2008) (explaining that a petitioner must establish "he is likely to suffer irreparable harm in the absence of preliminary relief."). This is more so, here, in light of the expedited briefing schedule in cases such as this one, where the government's response to the habeas petition is now due three days after filing of the TRO motion. Accordingly, the TRO motion, 12, is DENIED WITHOUT PREJUDICE. The seal motion 10 is REFERRED to the assigned U.S. Magistrate Judge. IT IS SO ORDERED. (iv) (Entered: 07/21/2026)
