MINUTE ORDER (Text Only Entry) signed by Magistrate Judge Frank J. Singer on 8/4/2026: MINUTE ORDER (Text Only Entry): On August 3, 2026, Respondents filed a motion to dismiss, (Doc. 5), indicating that Petitioner has a pending petition in Arguelles v. Warden, Case No. 3:26-cv-01098-WWB-SJH (M.D. Fla.), that may be duplicative of this action. Because the court needs more information regarding that petition to determine whether it is duplicative, the court hereby ORDERS Respondents to provide the court with a copy of that petition by no later than August 7, 2026.Petitioner is advised that if the petition is determined to be duplicative, the court may dismiss or stay the petition currently pending in this court until the Middle District of Florida rules on Petitioner's original petition. If Petitioner prefers that this petition move forward on the merits before this court, Petitioner may file a notice of voluntary dismissal in Arguelles v. Warden, Case No. 3:26-cv-01098-WWB-SJH (M.D. Fla.), and then inform this court of that dismissal. Upon any notice that the petition in Arguelles v. Warden, Case No. 3:26-cv-01098-WWB-SJH (M.D. Fla.), is dismissed, this court would then act on the petition currently pending before this court. (Deputy Clerk YV) (Entered: 08/04/2026)
