EO: On July 9, 2026, the Court received Petitioner's Verified Petition for Writ of Habeas Corpus ("Petition"), requesting, among other things, that the Court order "Respondents to release Petitioner immediately, or, in the alternative, provide Petitioner with a bond hearing and order Petitioner's release on conditions the Court deems just and proper." ECF No. 1 at PageID.16. Petitioner's counsel shall be responsible for (1) promptly effecting service of the Petition, any accompanying papers, and this Entering Order on Respondents and appropriate government counsel and (2) promptly filing proof(s) of service with the Court. Specifically, the Court DIRECTS Petitioner's counsel to: (1) serve Respondents, no later than Monday, July 13, 2026, with a copy of the Petition and all accompanying papers, along with a copy of this Entering Order, by overnight mail and by e-mail to all appropriate recipients; and (2) immediately file proof(s) of such service. Counsel for Respondents shall promptly enter a notice of appearance in this case. Moreover, the Court has reviewed the Petition. ECF No. 1. The Petition appears to raise arguments similar to ones this court accepted in Rico-Tapia v. Smith, 806 F. Supp. 3d 1166 (D. Haw. 2025). For that reason, the instant petition may be suitable for expedited disposition. See 28 U.S.C. § 2243 ("The court shall summarily hear and determine the facts, and dispose of [a petitioner's habeas petition] as law and justice require.").On or before July 20, 2026, Respondents are ORDERED TO SHOW CAUSE as to whether there are any factual or legal issues in this case that distinguish it from the Court's prior order in Rico-Tapia and justify denying the Petition, or, if there are none, indicate that the matter is not substantively distinguishable. After receiving Respondents' response to the Order to Show Cause, the Court will either rule on the Petition, request further briefing, or schedule a hearing as the circumstances warrant.Pending the Court's decision on the Petition, and unless and until the Court orders otherwise, the Court ORDERS that Respondents shall not transfer Petitioner out of this District. See F.T.C. v. Dean Foods Co., 384 U.S. 597, 604 (1966) (noting court's "express authority under the All Writs Act to issue such temporary injunctions as may be necessary to protect its own jurisdiction").
