MINUTES (IN CHAMBERS) by Judge Derrick K. Watson, On July 9, 2026, Petitioner Juan Hernandez Nunez, proceeding with counsel, filed both a petition for writ of habeas corpus and an emergency motion for temporary restraining order. Dkt. Nos. 1-2. The same day, pursuant to General Order 26-05, the Court set a briefing schedule on the petition for writ of habeas corpus, requiring an answer by July 16, 2026, and a reply within three days thereafter. Dkt. No. 6. In light of this expedited briefing schedule, and after review of the petition, motion for temporary restraining order, and Hernandezs statement, Dkt. No. 3, the Court is unconvinced that emergency relief is necessary in this case. See Winter v. Nat. Res. Def. Council, Inc., 555 U.S. 7, 20 (2008) (explaining that a petitioner must establish he is likely to suffer irreparable harm in the absence of preliminary relief.). Specifically, while Hernandez presents a medical condition in his statement, based upon the limited information provided with respect thereto, the Court does not find that Hernandez has established the likelihood of imminent, irreparable harm that is unaddressed by the expedited briefing schedule in this case. See General Order 26-05 at Section 3. Accordingly, to the extent Hernandez seeks emergency injunctive relief in this case, Dkt. No. 2, such relief is DENIED WITHOUT PREJUDICE. Proceedings on the merits of the underlying habeas petition shall continue before the Magistrate Judge. IT IS SO ORDERED. denying 2 MOTION for TRO. TEXT ONLY ENTRY. NO PDF ATTACHED.
