This is a text only entry; no document issued. ORDER granting in part and denying in part 5 Motion for TRO. Petitioner alleges three basic claims in the habeas petition: (1) this court should enforce the preliminary injunction issued by a court in California in a class action in that California district court; (2) this court should release petitioner from detention under Zadvydas; and (3) this Court should order another bond hearing by the immigration judge. Petitioner has not shown a substantial likelihood of success on any of these claims. First, Petitioner does not explain why the California Court that issued the classwide preliminary injunction cannot enforce its own injunctions. Second, Petitioner does not explain how Petitioner's Zadvydas rights are violated if Petitioner is currently being deported, and thus will no longer be in custody shortly, according to Petitioner. Lastly, this Court has previously held that it does not have jurisdiction to overrule individualized bond hearing determinations by an immigration judge. Notwithstanding these weaknesses in Petitioner's habeas petition, the Court is concerned by Petitioner's counsel's contention that Respondents, knowing that Petitioner was represented by counsel, took adverse legal actions to Petitioner's detriment without reasonably assuring counsel had the opportunity to provide representation during those proceedings. Accordingly, the Court orders Respondents not to remove Petitioner from Stewart Detention Center until the Magistrate Judge in this case can make a determination whether there is any merit to counsel's allegations that Respondents willfully and unlawfully denied Petitioner the right to be represented by chosen counsel during the proceedings that led to the order of removal.
