(IN CHAMBERS) ORDER by Magistrate Judge Rozella A. Oliver: Denying Petitioner's Application for Temporary Restraining Order ("TRO Application") 6 . Pursuant to General Order No. 26-05, the Court has set an expedited briefing schedule for the petition for writ of habeas corpus in this case. It is not certain that the merits of the TRO Application can be decided before the merits of the habeas petition. Even if there is a delay that results from awarding relief to Petitioner on the merits of the petition, it would be brief. Accordingly, the Court concludes that awarding relief via a TRO is not warranted. See Winter v. Natural Res. Def. Council, Inc., 555 U.S. 7, 22 (2008). ORDER by Magistrate Judge Rozella A. Oliver: Re: 16 Petitioner's EX PARTE APPLICATION for Clarification and Enforcement of Judgment. Petitioner seeks clarification that a July 30, 2026 custody determination hearing that occurred while the instant matter was pending before the Court does not satisfy the Court's August 13, 2026 order granting in part the petition for writ of habeas corpus. In issuing its August 13, 2026 order, the Court was unaware of the July 30, 2026 bond hearing. The Court does not deem this earlier hearing as satisfaction of an order issued two weeks later. Accordingly, the Court clarifies that Respondents must provide Petitioner with another bond hearing as set forth in the Court's August 13, 2026 Order. See Dkt. No. 14.
