District Judge Leo T. Sorokin: ELECTRONIC ORDER entered. This matter was referred to the undersigned as the emergency judge, due to the filing by the respondents of a motion seeking permission to transfer the petitioner to a facility in Texas as "soon as possible, and preferably today." Doc. No. 6 at 1. After review of the habeas petition, the emergency motion to transfer, and the opposition to that motion, the Court discerns the following facts. The petitioner is a woman who has been held at the Burlington ICE Field Office for nearly a week, since July 7, 2026. Doc. No. 1 at 1. The Burlington Field Office is not an appropriate facility for the overnight custody of individuals, something the respondents acknowledge, Doc. No. 6 at 1, and this Court has concluded in other cases. The petitioner alleges, with supporting documents, that she has lived in the United States for five years, was previously released on recognizance by the respondents, and has complied with the conditions of her supervision by ICE. The respondents identify no facts suggesting the petitioner poses a danger or a flight risk in support of their emergency motion to transfer or otherwise. Transfer will interfere with the petitioner's access to counsel as well as delay any removal proceedings. See Doc. No. 7 . Under these circumstances, the Court enters the following orders: (1) the emergency motion to transfer is DENIED; and (2) pending resolution of the merits of the habeas petition (which will occur after respondents file their answer, due tomorrow, Doc. No. 3 ), the respondents shall RELEASE the petitioner from custody no later than 6:00 PM today, Monday, July 13, 2026. These rulings are without prejudice to the respondents seeking, or the Court ordering, a bond hearing (or any other appropriate relief) when resolving the merits of the habeas petition.(KB) (Entered: 07/13/2026)
