(In Chambers) Order by Judge Stanley Blumenfeld, Jr.: Petitioner filed an ex parte application for a temporary restraining order (TRO) in this ongoing habeas proceeding, arguing that his conditions of confinement violate due process because he has received inadequate medical care. Dkt. No. 11. Petitioner requests supervised release or, alternatively, an order requiring the government to arrange an in-person examination by a physician and diagnostic testing. In the TRO application, counsel for Petitioner states that he notified the government of the application approximately 24 hours ago and that the government had not yet taken a position. Id. at 1415. The parties are ordered to promptly meet and confer regarding the requested relief and shall promptly file a joint stipulation if they reach an agreement. (In Chambers) Order by Judge Stanley Blumenfeld, Jr.: Petitioner has filed an ex parte application for a temporary restraining order (TRO) based on his claim that he is receiving constitutionally inadequate medical care. That claim challenges the conditions, rather than the legality, of his confinement and therefore is not cognizable under 28 U.S.C. § 2241. See Pinson v. Carvajal, 69 F.4th 1059, 1065, 1073 (9th Cir. 2023) (explaining that a claim alleging deliberate failure to provide adequate medical care challenges conditions of confinement rather than the fact or duration of custody). That Petitioner seeks release as one form of relief does not transform his conditions-of-confinement claim into a habeas claim; the relevant question is whether success on the claim would legally require his release. Id. at 1072-73 ("[A] successful claim sounding in habeas necessarily results in release, but a claim seeking release does not necessarily sound in habeas."). Indeed, Petitioner's alternative request for an examination and diagnostic testing confirms that the alleged violation could be remedied without release. See id. at 1073-75 (holding that where the body of the petition demonstrates that relief short of release could remedy the alleged constitutional deficiency, the claim lies outside the core of habeas). Accordingly, Petitioner may not obtain relief on his medical-care claim in this § 2241 proceeding, and his ex parte application for a temporary restraining order is denied.THERE IS NO PDF DOCUMENT ASSOCIATED WITH THIS ENTRY.
