ORDER denying 4 Motion for TRO. Petitioner Guzman Enriquez is an alien (native and citizen of Guatemala) who entered the United States in April 2001. He was detained by ICE on June 8, 2026 and is now in custody at the Moshannon Valley Processing Center. He filed a Petition for Writ of Habeas Corpus, arguing, inter alia, that he is entitled to immediate release or an individualized a bond hearing wherein the Government would bear the burden of proving by clear and convincing evidence that his continued detention is necessary because he poses a danger to the community or a substantial risk of flight. He has filed a Motion for Temporary Restraining Order seeking the same relief as specified in his Petition. The Court is compelled to deny the Motion for TRO. Petitioner's request for an injunction ordering immediate release or an immediate bond hearing seeks the same substantive relief sought by his Petition. It is affirmative relief, rather than the maintenance of the status quo. An ex parte TRO is not an appropriate avenue for this type of relief. Rather, the Court will give prompt consideration to the merits of the Petition upon the expedited case management schedule that will issue forthwith. The Court, therefore, denies the Motion for TRO.
