MEMORANDUM ORDER - GRANTING/DENYING in part petition for writ of habeas corpus; The government shall, within 14 days , provide Mendoza with an individualized bond hearing before an IJ in accordance with the analysis in the memorandum order ; A t that hearing, the government will bear the burden of establishing by clear and convincing evidence that Mendoza's continued detention is necessary because he presents a flight risk or danger to the community if released; On or before Oct ober 9, 2026, respondents shall file a declaration pursuant to 28 U.S.C. § 1746 confirming that Mendoza has received a bond hearing; the Clerk of Court is directed to enter judgment and CLOSE this case.
