Judge Myong J. Joun: ELECTRONIC ORDER entered. In their Response to Habeas Petition, Doc. No. 9, Respondents acknowledge that the legal issues presented in this petition are similar to those resolved in prior cases in this district. Given this, and in light of the record before me, the Petition for Writ of Habeas Corpus is GRANTED. Respondents are ORDERED to provide Petitioner with a bond hearing under 8 U.S.C. § 1226(a) by July 16, 2026. The Respondents are ENJOINED from denying bond to Petitioner on the basis that he is detained pursuant to 8 U.S.C. § 1225(b)(2). Unless Petitioner was provided a bond hearing, Respondents shall release Petitioner by 6 PM on July 16, 2026. The Respondents are further ORDERED to file a status report within 24 hours of the bond hearing, stating whether Petitioner has been granted bond, and, if his request for bond was denied, the reasons for that denial, or whether he has been released, and if so, the date, time, and location of his release. Judge Myong J. Joun: ELECTRONIC ORDER entered. On July 20, 2026, Petitioner filed a motion to enforce the habeas order in this case. See Doc. No. 12 ; Doc. No. 13 . Petitioner argued (1) that the bond hearing provided following this Court's initial grant of habeas relief failed to meet constitutional and statutory standards, and (2) that the preliminary injunction in Immigration Center for Women and Children v. Mullin, No. 2:25-cv-09848, 2026 WL 1455004 (C.D. Cal. May 20, 2026) prevented Petitioners detention as a class member. [Doc. No. 13 at 2]. Both arguments fail to persuade, and the motion to enforce is DENIED. After review of the record before me, including the evidence before the Immigration Judge at Petitioners bond hearing, I find that the hearing met constitutional and statutory standards. Further, Petitioners detention by ICE occurred on 6/27/26, and he submitted his Form I-914A application on 7/3/26, making any argument under ICWC unpersuasive. See [Doc. No. 16-1 at ¶¶ 1314]. For these reasons, Doc. No. 12 ; Doc. No. 13, are DENIED. (SP) (Entered: 07/27/2026)
