ORDER DISMISSING PETITIONER'S PETITION AS MOOT AND CLOSING CASE ON DOCKET WITHOUT PREJUDICE. The Petitioner submitted a pro se Petition for Writ of Habeas Corpus [ECF 1] dated June 26, 2026. The Clerk of this Court received that hard-copy filing and docketed it on July 2, 2026. But in the interim, on June 29, 2026, the Petitioner's application for voluntary departure was granted by an Immigration Judge ("IJ"). The Respondents in this Action have filed the IJ's Order on the docket at ECF 6-1, confirming that IJ's approval of the "voluntary departure with safeguards" of the Petitioner. As such, the Petitioner's assertion in his habeas corpus petition that he should be subject to detention under 8 U.S.C. § 1226(a) instead of 8 U.S.C. § 1225(b)(2) and therefore entitled to a bond hearing is moot, because he is no longer subject to detention under either. He is now subject to detention under 8 U.S.C. § 1229c(a)(2) and 8 C.F.R. § 240.25(b), which allows "any conditions... deem[ed] necessary" to be attached to a grant of voluntary departure, including detention pending departure. The Court therefore dismisses the Petitioner's Petition [ECF 1] and closes the case on the docket without prejudice to it being reopened for good cause shown. Signed by Judge Mark R.
