TEXT ORDER - The Court has reviewed the Petition for a Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241 filed by Petitioner, Everado Ventura-Felix, who is presently detained at Delaney Hall Detention Facility in Newark, New Jersey. (ECF No. 1.) Petitioner alleges his continued detention pursuant to Matter of Q. Li, 29 I&N Dec. 66 (BIA 2025) and Matter of Yajure Hurtado, 29 I&N Dec. 216 (BIA 2025) violates the Due Process Clause of the Fifth Amendment. Petitioner further alleges that his detention should not be governed by the mandatory detention provisions of 8 U.S.C. § 1225(b)(2)(A), but rather, § 1226(a). (Id.) Accordingly, IT IS ORDERED that Respondents shall SHOW CAUSE, on or before July 13, 2026, why the Petition for a Writ of Habeas Corpus should not be granted. Petitioner may file a reply within three (3) business days after Respondents file their response. Petitioner shall serve a copy of the Petition and this Order upon Respondents within two (2) business days of the entry of this Order and shall promptly file proof of service on the docket. Petitioner shall not be removed from the District of New Jersey during the pendency of these proceedings. So Ordered by Judge Karen M. Williams on July 6, 2026.
