Service of 28 U.S.C. § 2241 Petition and Appointment of Counsel Order IT IS THEREFORE ORDERED that the Federal Public Defender (FPD) for the District of Nevada is appointed to represent the petitioner and is directed to file a notice of appearance within 7 days of the date of this order. If the FPD is unable to represent the petitioner, because of a conflict of interest or for any other reason, alternate counsel will be appointed. Appointed counsel will represent the petitioner in all federal proceedings related to this matter, including any appeals or certiorari proceedings, unless allowed to withdraw. IT IS FURTHER ORDERED that if the FPD files a notice of appearance in this matter, it will then have 14 days to file (1) a motion to proceed IFP or pay the $5 filing fee on behalf of the petitioner and (2) an amended petition, or (3) a motion to dismiss the petition. The FPD must effectuate service of the amended petition on the respondents. IT IS FURTHER ORDERED that the Clerk of the Court is directed to: See order for additional information. IT IS FURTHER ORDERED that the United States Attorneys Office for the District of Nevada must file a notice of appearance within 7 days of the date of this order and file and serve their answer to the amended petition within 7 days of service of the counseled amended petition. The respondents must file any documents referenced or relied upon in their responsive pleading with that pleading. Petitioner will have 7 days to file a reply. IT IS FURTHER ORDERED that the parties must meet and confer regarding any requests for an extension of deadlines and stipulate to the extension if possible. Any motion for extension must certify efforts taken to meet and confer and indicate the opposing partys position regarding the extension. Any motion or stipulation must comply with Federal Rule of Civil Procedure 6(b) and Local Rules IA 6-1, 6-2. IT IS FURTHER ORDERED that the USAO must produce the following documents to the FPD (or certify that such documents are not in their custody or control) within 7 days of the date of this order: See order for additional information. IT IS FURTHER ORDERED that the respondents must not transfer the petitioner out of this district, with the exception of effectuating the petitioners lawful deportation. MINUTE ORDER IN CHAMBERS of the Honorable Judge Jennifer A. Dorsey on 7/24/2026. Petitioner Jhony Gerardo Castillo Castellanos seeks an extension of time to file an amended petition or a motion to dismiss 9, contending that the government has provided notice of his removal to Honduras 8 but it failed to provide a complete I-205 form verifying his deportation. The government's counsel has represented that it will send a completed form when they receive it.IT IS HEREBY ORDERED that the government must file a supplemental notice by July 31, 2026, with certified documentation showing that Castellanos was lawfully removed. Those documents must be properly signed, certified, and unredacted. If signed forms aren't available to the government, it must provide an affidavit from the appropriate DHS official with personal knowledge of his removal certifying that Castellanos was lawfully removed.Castellanos's motion to extend time 9 is GRANTED. MINUTE ORDER IN CHAMBERS of the Honorable Judge Jennifer A. Dorsey on 8/13/2026. On July 24, 2026, the court directed the respondents to file, by July 31, 2026, a supplemental notice "with certified documentation showing that" petitioner Jhony Gerardo Castillo Castellanos "was lawfully removed." 10 The federal respondents did not comply with that order, so Castellanos moves for an order to enforce it. 12 I grant Castellanos's motion and order the government to show cause by August 18, 2025, why it failed to comply with the court's July 24, 2026 order.Castellanos also moves to extend his deadline to file a motion to dismiss or an amended petition until after the government complies with the court's order. 11 That motion is GRANTED.
