The Court intends to rule directly on the Petition, with the understanding that the Court will also consider any arguments made in support of the motion. See Fed. R. Civ. P. 65(a)(2). Within 2 court days, Respondents shall answer the Petition. Failure to timely respond shall be construed as a non-opposition. See L.R. 230(c). Pending the Court's ruling on the Petition, Respondents shall NOT TRANSFER Petitioner out of this District. MINUTE ORDER issued by the Courtroom Deputy for District Judge Dena M. Coggins on 7/7/2026: In Petitioner's 1 Petition for Writ of Habeas Corpus and 3 Motion for a Temporary Restraining Order, Petitioner argues that her detention has grown unconstitutionally prolonged and that the evidence presented at the two bond hearings she was previously provided pursuant to the Temporary Restraining Order issued by the court on 1/31/2026 in Petitioner's first habeas action (1:26-cv-00569-DC-CSK) were insufficient to justify her continuing detention. However, as Respondents emphasize in their 9 Opposition, in Petitioner's first habeas case, the court issued an Order on 6/11/2026 granting habeas relief, finding that "[b]ecause Petitioner received the renewed bond hearing in compliance with this Court's January 31, 2026 Order (ECF No. 9), no further relief is warranted." In the 1 Petition and 2 Motion filed in this case, Petitioner does not present any new facts or arguments that would require reconsideration of that Order. Accordingly, the 3 Motion for a Temporary Restraining Order is DENIED. To the extent Petitioner argues that the evidence considered by the Immigration Judge was insufficient to meet the Government's burden, that is an argument to be raised to the Board of Immigration Appeals, not this court. Loba L.M. v. Andrews, No. 1:25-cv-00611-JLT-SAB, 2026 WL 710307, at *8 (E.D. Cal. Mar. 13, 2026) ("Petitioner challenges the sufficiency of the evidence supporting the immigration judge's bond determination rather than the constitutionality of the process by which that determination was reached... Complaints about the conclusion the IJ reached must be presented through the normal immigration appeal process."). Further, because this case (1:26-cv-05006-DC-CSK) involves the same Petitioner, alleges identical facts, and requests identical relief as Petitioner's earlier filed case, No. 1:26-cv-00569-DC-CSK, this case, 1:26-cv-05006-DC-CSK is hereby DISMISSED AS DUPLICATIVE. The Clerk of the Court is DIRECTED to close this case. Any further filings regarding Petitioner's immigration detention shall be filed in Case No. 1:26-cv-00569-DC-CSK.
