ORDER granting in part 11 Urgent Motion Requesting Order to Return Petition to the Jurisdiction of the Commonwealth of Puerto Rico (Urgent Motion) filed on behalf of Jose Ignacio Cambero Maldonado ("Petitioner"). Petitioner filed his Petition for Writ of Habeas Corpus on June 29, 2026, challenging his detention by U.S. Immigration and Customs Enforcement (ICE) and seeking an order barring his transfer outside the District of Puerto Rico. At the time of filing, Petitioner was physically detained within this District. Alongside the habeas, Petitioner filed an Emergency Motion for Temporary Restraining Order (TRO) at Docket No. 3, which this Court on June 30, 2026 denied without prejudice for failure to comply with Local Rule 65. Petitioner refiled the TRO that same day. (Docket No. 9). Petitioner also represented to the Court that summons had been executed on June 30, 2026 as well. (Docket No. 11 at 2). On July 1, 2026, this Court entered an Opinion and Order (Docket No. 10), granting Petitioner's TRO (Docket No. 9), which, among other relief, directed that Petitioner not be transferred outside the District of Puerto Rico and ordered that he be afforded a bond hearing before an Immigration Judge. The record before the Court reflects that, on June 30, 2026 the day after the Petition was filed and one day before the Court's Opinion and Order issued Respondents transferred Petitioner from Puerto Rico to the Krome North Service Processing Center in Miami, Florida. On July 1, 2026, the Immigration Judge in the Guaynabo (San Juan) determined that he lacked jurisdiction to conduct Petitioners custody redetermination because Petitioner was then detained at the Krome facility in Miami, Florida. (Docket No. 11-1). The bond hearing this Court ordered in its July 1, 2026 Opinion and Order therefore did not, and as matters currently stand cannot, take place. See (Docket No. 11-1). Respondents' transfer of Petitioner does not, however, divest this Court of jurisdiction over the pending habeas petition. Jurisdiction under 28 U.S.C. § 2241 is assessed at the time the petition is filed, and 28 U.S.C. § 1631 governs jurisdiction after transfer. See Rumsfeld v. Padilla, 542 U.S. 426, 441, 447 (2004). Petitioner was detained within this District when the Petition was filed on June 29, 2026. That jurisdiction, once properly acquired, is not defeated by a respondent's subsequent transfer of the petitioner to another district. See Ex parte Endo, 323 U.S. 283, 304-05 (1944) (rejecting mootness after transfer where a respondent capable of effecting the petitioner's release remained subject to the court's jurisdiction); Rumsfeld, 542 U.S. at 441 (distinguishing Endo on the ground that there was no indication the transfer at issue was an attempt to manipulate jurisdiction). That qualification in Rumsfeld is instructive here. Petitioner was transferred out of this District the day after the Petition was filed, and the Immigration Judge's subsequent refusal to conduct the bond hearing this Court had ordered, premised expressly on Petitioner's relocation to Florida, demonstrates that the post-filing transfer has had the practical effect of preventing implementation of the relief previously ordered by this Court. These circumstances implicate the concern recognized in Endo that a post-filing transfer should not deprive a court of its ability to resolve a properly filed habeas petition. See also Ozturk v. Hyde, 136 F.4th 382, 387 (2nd Cir. 2025); Ozturk v. Trump, No. 25-cv-00374, 2025 WL 1318154 (D. Vt. Apr. 18, 2025) (retaining jurisdiction and ordering return of a habeas petitioner transferred out of the district where the petition was filed). Under these circumstances, the Court finds that it retains jurisdiction over the Petition and over the individuals responsible for Petitioner's custody for purposes of preserving its jurisdiction and effectuating the relief previously ordered. Accordingly, it is ORDERED that: (1) Respondents, their officers, agents, employees, representatives, and all persons acting in concert with them, shall return Petitioner Jose Ignacio Cambero Maldonado to the jurisdiction of the District of Puerto Rico, no later than five (5) calendar days from the date of this Order; (2) Respondents shall file written notice with the Court, and serve a copy on undersigned counsel for Petitioner, confirming Petitioner's return to Puerto Rico within twenty-four (24) hours of such return; (3) Respondents, their officers, agents, employees, representatives, and all persons acting in concert with them, are enjoined from transferring, relocating, or removing Petitioner outside the District of Puerto Rico during the pendency of this matter, absent express prior authorization from this Court; (4) Upon Petitioner's return to this District, Respondents shall promptly facilitate the bond hearing before an Immigration Judge with jurisdiction over Petitioner's place of detention, as ordered in the Court's July 1, 2026 Opinion and Order (Docket No. 10); and (5) If Respondents do not timely comply with this Order, Petitioner may seek appropriate relief, including an order directing Respondents to show cause why further sanctions, including contempt, should not issue.Signed by Judge Gina R. ORDER denying 1 Petition for Writ of Habeas Corpus. Pursuant to the Respondent's filing at Docket No. 17, Petitioner was transferred back to the District of Puerto Rico on July 6, 2026 and granted a bond hearing on July 8, 2026, pursuant to this Court's order at Docket No. 12 and was released on bond that same day. This Court then ordered Petitioner to show cause at Docket No. 22 as to why his habeas petition should not be dismissed. Petitioner failed to respond. Typically, "[a] habeas petition will become moot once the prisoner is released from custody unless the petitioner can show some sufficient collateral consequence of the underlying proceeding." Leitao v. Reno, 311 F.3d 453, 455 (1st Cir. 2002). The record does not reflect that Petitioner made such arguments regarding collateral consequences or other applicable exceptions; moreover, Petitioner's underlying custody/removal posture isn't inherently transitory in a way likely to recur and evade review to warrant an exception. Since the remedy requested by Petitioner was granted, there is no pending controversy before the Court. As such, the Court hereby DISMISSES WITHOUT PREJUDICE Petitioner's claims for mootness.
