TEXT ORDER that, the Court having reviewed Petitioner's habeas petition in this matter (ECF No. 1), the Government is ORDERED to show cause within seven days why Petitioner should not be ordered released from custody pursuant to this Court's decisions in Valerio v. Joyce, No. 25-17225, 2025 WL 3251445 (D.N.J. Nov. 21, 2025), Hueso v. Soto, No. 26-1455, 2026 WL 539271 (D.N.J. Feb. 26, 2026), and Fajardo-Nugra v. Soto, No. 26-975, 2026 WL 579192 (D.N.J. Mar. 2, 2026). Petitioner may file a reply within three days of the date on which the Government files its response to this Order. The Government shall not transfer petitioner out of Delaney Hall until this matter concludes. The Government shall further inform the Court of any transfer of Petitioner out of Delaney Hall within twenty-four hours of its occurrence, including those which predate the Court's injunction on transfers. In addition to what is set out above, a declaration from ICE shall also be filed. It shall indicate that ICE has (i) received this Court's Order prohibiting Petitioner's transfer from Delaney Hall; and (ii) received written legal advice from the United States Attorney's Office on the subject of ICE's obligation to comply with that Order. The declaration shall be filed on the public docket of the Court on or before 12:00 p.m. on June 30. The declaration must be executed by either the Newark ICE Field Office Director or by the Newark ICE Field Office Deputy Director. The declaration may be signed by hand or electronically. Finally, the United States Attorney's Office shall immediately file a letter on the Court's public docket if an Order of the Court is violated in connection with this case. TEXT ORDER that the Court is in receipt of the Government's letters (ECF Nos. 5,8) regarding Petitioner's location. In its first letter, the Government indicates that ICE transferred Petitioner out of New Jersey on an ICE flight at approximately 6 p.m. on June 29, a few minutes before the Court's no transfer order was entered. While the letter and attached certification indicate that Petitioner's flight was a "6 p.m." flight, it does not clearly indicate Petitioner's exact location at 6:10pm, whether he was specifically on the plane by that time, whether the flight was actually in the air, and whether at least arguably Petitioner was outside New Jersey air space when the Court's order was issued at 6:10 p.m. on June 29. (See ECF No. 2.) The Government shall therefore provide the Court with this more detailed information regarding Petitioner's exact location at the time the order was issued by noon on July 2, 2026. This information shall be supported by either clear documentary evidence or certifications from individuals with personal knowledge. The Government shall also address whether Petitioner will be returned to New Jersey in the near future in light of the Court's no-transfer orders, and the Government shall not further transfer Petitioner during the pendency of this matter unless it is to return her to New Jersey. TEXT ORDER: In its response to Petitioner's habeas petition in this matter (ECF No 10 ), the Government reported that Petitioner was detained under 8 U.S.C. § 1226(a) and had requested a bond hearing under that statute, which was scheduled and forthcoming. Since that time, neither party has updated the Court on that bond hearing. The Government shall therefore update the Court on Petitioner's bond hearing within forty-eight hours. Petitioner may file a response to that update within twenty-four hours of its filing. The Court further notes that, in its response, the Government agreed to facilitate Petitioner's return to New Jersey in light of the reported facts regarding his transfer, which occurred essentially simultaneously with the Court's entry of an order barring transfers. (See ECF No. 10 at 2.) In light of the fact that his order was entered while Petitioner was still in New Jersey, the Government shall return Petitioner to a facility within New Jersey within seventy-two hours and Petitioner shall thereafter remain in that New Jersey immigration facility until this Court resolves this matter.
