Jul 02, 2026
District Judge Angel Kelley: ELECTRONIC ORDER entered. Petitioner was ordered to show cause as to why this Petition should not be transferred to the District of New Hampshire on or before July 7, 2026. On July 2, 2026, the Parties filed a joint response [Dkt. 10] asking the Court to retain jurisdiction over the case. The Court is satisfied that it has jurisdiction. [W]hen the Government moves a habeas petitioner after she properly files a petition naming her immediate custodian, the District Court retains jurisdiction and may direct the writ to any respondent within its jurisdiction who has legal authority to effectuate the prisoner's release. Rumsfeld v. Padilla, 542 U.S. 426, 441, (2004) (citing Ex parte Endo, 323 U.S. 283 (1944)); see generally Brian R. Means, Federal Habeas Manual § 1:104 (2026) (If a petitioner properly brings a habeas action in a particular district, then, for reasons not related to the petition, he is transferred to a district in another state while the petition is pending, the court in which the petition originally was filed retains personal jurisdiction and remains the appropriate venue.). Accordingly, the Court will maintain jurisdiction over the case because Petitioner filed her petition in this district prior to being transferred to the District or New Hampshire. As an additional matter, the Court grants Respondents request for an extension to file a response to the petition by July 13, 2026 (CEH) Modified on 7/6/2026 to fix typo in docket text. NEF regenerated to all parties (CEH). (Entered: 07/02/2026)
