TEXT ORDER: The Court has reviewed the Petition for Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241 filed by Petitioner, Arturo Garcia Vasquez ("Petitioner"), who is currently detained at the Delaney Hall Detention Facility in Newark, New Jersey. (ECF No. 1.) According to the Petition, Petitioner is a 43-year-old native and citizen of Guatemala who has resided continuously in the United States for nearly twenty-one years and is a long-term resident of New Jersey. Petitioner alleges that he was taken into custody by United States Immigration and Customs Enforcement on or about June 24, 2026, at his workplace in connection with the pursuit of another individual, and that he was not the target of the enforcement action. Petitioner further alleges that he has no criminal history and is not the subject of any known removal proceedings. The Court further notes that, according to the Petition, Petitioner has longstanding ties to the United States, including approximately eighteen years of continuous employment with the same employer, family ties to his adult daughter who resides lawfully in the United States, and eligibility for potential humanitarian immigration relief based on his status as a survivor of domestic violence. Petitioner also alleges that no Notice to Appear in immigration proceedings has been issued to date. (Id.) The Court concludes that Petitioner may be unlawfully detained under 8 U.S.C. § 1225 because he was apprehended inside the United States after a lengthy period of residence and is presently detained without a clear procedural posture establishing lawful custody authority under that provision. See Ayala Amaya v. Bondi, No. 25-cv-16428, 2025 WL 3033880 (D.N.J. Oct. 30, 2025). THEREFORE, Respondents shall RELEASE Petitioner within twenty-four (24) hours under the same conditions, if any, that existed prior to his detention, including, but not limited to: (1) release within the State of New Jersey; (2) no additional conditions of supervision, including electronic monitoring devices; (3) return of all clothing, personal effects, and documents seized at the time of arrest; and (4) restoration of any property in Respondents' possession. If Respondents contend that Ayala Amaya is meaningfully distinguishable, they shall file a response to the Petition by July 8, 2026. Petitioner may file a reply within three (3) business days thereafter. Petitioner shall not be removed from the District of New Jersey during the pendency of these proceedings.
