Judge William G. Young: ELECTRONIC ORDER entered as to Maria Magdalena Guaman Pomaquiza.Respondents notified this Court of their intent to move petitioner Maria Magdalena Guaman Pomaquiza (“Guaman Pomaquiza”) to the Northern District of Ohio, citing no currently available bed space in Massachusetts to house her pending the outcome of her habeas petition. Resp’ts’ Notice Intent Transfer, ECF No. [ 11 ]. The Court has reviewed the petition for habeas relief under 28 U.S.C. § 2241 (“Petition”), ECF No. [ 1 ], the Respondent’s response, ECF No. [ 6 ], as well as the Petitioner’s opposition to the notice of intent to transfer, ECF No. [ 12 ].The Court discerns the following alleged facts: Guaman Pomaquiza is a woman, a mother of two United States citizen children, who has lived in the United States for twelve years, and has no criminal history. Petition ¶ 1. Respondents identified no facts suggesting she poses a danger to the community or a flight risk.Under these circumstances, the Court agrees with the approach adopted by Judge Sorokin in his recent order in Sumba Allaico v. Hyde, 1:26-cv-13125, ECF No. 8 (D. Mass. Jul. 13, 2026).Accordingly, the Court enters the following order: pending resolution of the merits of the habeas petition, Respondents shall RELEASE Petitioner forthwith. This ruling has no bearing on the bond hearing previously ordered by this Court, ECF No. [ 13 ], or any other appropriate relief when resolving the merits of the habeas petition.SO ORDERED.
