TEXT ORDER - : The Court has reviewed the Petition for a Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241 (ECF No. 1) and the Motion for an Order to Show Cause ("Motion") (ECF No. 2) filed by Petitioner, Manoj Pun ("Petitioner"), who is presently detained at Delaney Hall Detention Facility. According to the Petition, Petitioner is a native and citizen of Nepal who entered the United States in 2014 and has resided here since. Petitioner alleges that he was ordered removed in 2014 but, because Respondents were unable to effectuate his removal, he was released under an Order of Supervision ("OSUP"). Petitioner further alleges that he complied with the conditions of his release for more than a decade before being detained by Immigration and Customs Enforcement during a scheduled check-in on June 24, 2026, at which time his OSUP was purportedly revoked. Petitioner contends that his present detention is unlawful because Respondents revoked his OSUP without providing reasonable notice as required by 8 C.F.R. § 241.4(l)(1). See generally Zhang v. Genalo, 814 F. Supp. 3d 307, 322-28 (E.D.N.Y. 2025). For good cause shown, the Motion is GRANTED. Accordingly, IT IS on this 1st day of July, 2026, ORDERED that Respondents shall SHOW CAUSE, on or before July 7, 2026, why the Petition should not be granted. Petitioner may file a reply within three (3) business days after Respondents file their response. Petitioner shall serve a copy of the Petition and this Order upon Respondents within two (2) business days of the entry of this Order and shall promptly file proof of service on the docket. Petitioner shall not be removed from the District of New Jersey during the pendency of these proceedings. So Ordered by Judge Karen M. Williams on July 1, 2026.
