MINUTE ORDER granting 2 Plaintiff's Motion to Issue Summons: Because 8 U.S.C. § 1451(b), which is incorporated through 8 U.S.C. § 1440(c), provides a defendant with "sixty days' personal notice," the Court agrees with Plaintiff that the summons form for 28 U.S.C. § 1608, which states that a recipient has sixty days to respond, is a more appropriate summons than the standard summons in a civil case, which informs the recipient they must respond in twenty-one days. The Court appreciates that Section 1608 applies only to foreign-state defendants, but because it is the only form at this time that accurately states the defendant's time to respond, the Court finds that it is better than the alternative. Accordingly, it is hereby ORDERED that the Clerk of the Court shall issue the proposed summons that Plaintiff lodged with the Court in ECF No. 1-16. SO ORDERED.
