ORDER. Singh, as an "applicant for admission," is properly detained without bond under Section 1225(b)(2)(A). Buenrosto-Mendez, 166 F.4th at 498. And the Due Process Clause does not require a bond hearing in these circumstances. Thus, the petition for a writ of habeas corpus (Dkt. No. 1 ) is denied. The respondents shall file their supplemental brief on or before July 20, 2026. The respondents must file with their brief all records relevant to the resolution of the petitioner's habeas petition. The petitioner may file a response to the respondents' supplemental brief by no later than July 27, 2026. The Court expects to issue an order resolving the petition no later than August 3, 2026. ORDER. The Court ordered the parties to submit supplemental briefs addressing the Fifth Circuit's recent decision in Sosnava Rodiguez v. Ortega. Dkt. No. 7 . However, on July 10, 2026, the Fifth Circuit ordered that the case be reheard en banc and vacated the panel decision pursuant to Fifth Circuit Rule 41.3. Accordingly, the order for supplemental briefing (Dkt. No. 7) is vacated. The Court has reviewed the panel opinion in Sosnava Rodiguez and respectfully disagrees with its conclusion. Because the petitioner's motion to reconsider relies exclusively on Sosnava Rodriguez, see Dkt. No. 6 at 2, the petitioner's motion to reconsider (Dkt. No. 6) is denied.
