ORDER and FINDINGS AND RECOMMENDATIONS signed by Magistrate Judge Sean C. Riordan on 8/18/2026 DENYING Petitioner's motion to proceed in forma pauperis 2 based on his payment of the filing fee; DENYING 3 Motion for Appointment of Counsel as moot; IT IS FURTHER RECOMMENDED that Petitioner's application for a writ of habeas corpus 1 be granted. Respondent be ordered to provide Petitioner Ruben Lorenzo (A# 098-983-921 )with a bond hearing before an immigration judge at which the government shall bear the burden of justifying Petitioner's continued detention by clear and convincing evidence, within fourteen (14) days from any order resolving the § 2241 petition. Respondent be further required to provide seven (7) days advance written notice of the bond hearing date to Petitioner as well as any immigration counsel of record for Petitioner. Respondent be further directed to file a notice certifying compliance with the above provision within seven (7) days from the date of the bond hearing. If petitioner is granted release on bond, respondent shall return all of petitioner's documents and possessions at the time of release.
