TEXT ORDER - Currently pending before the Court is Petitioner Nolberto Dionicio Paul's petition for a writ of habeas corpus and motion for a temporary restraining order ("TRO"). ECF Nos. 1-2. The petition and TRO indicate that Petitioner suffers "severe, chronic medical conditions--including diabetes, high blood pressure, and gout--and [that he] currently has an open wound on his right foot." ECF No. 1 1. Petitioner further states that his conditions "require rigorous, continuous management" including regular insulin. Id. 20. He also states that he "previously had a toe amputated due to diabetic complications" and that due to his "medical history of gangrene, [his] open wound places him at an extreme, immediate risk of developing gangrene and facing further amputation if he is denied specialized sanitary conditions and medical care." Id. The parties are hereby ORDERED to meet and confer today, June 25, 2026, to discuss the issues presented by Petitioner. By tomorrow, June 26, 2026, at 12:00 p.m., the parties shall file a joint status update informing the Court as to whether Petitioner is receiving proper medical care. Additionally, Petitioner shall not be removed from a facility within the District of New Jersey, or from the United States, without permission from this Court. The Court has authority to stay removal under the All Writs Act. See 28 U.S.C. § 1651 (permitting courts to "issue all writs necessary or appropriate in aid of their respective jurisdictions and agreeable to the usages and principles of law"); F.T.C. v. Dean Foods Co., 384 U.S. 597, 604 (1966) (recognizing "a limited judicial power to preserve the court's jurisdiction or maintain the status quo by injunction pending review of an agency's action through the prescribed statutory channels"); see also Dabone v. Petitioner, who is diabetic, states his blood sugar dropped "dangerously low," and that the additional insulin he received in response is causing severe chest pain. He also states that his foot wound remains untreated. As such, Petitioner argues that "immediate release is the appropriate relief in this case."
