Judge Brian E. Murphy: ELECTRONIC ORDER entered. “Respondents submit that the legal issues presented in this Petition concerning detention under 8 U.S.C. § 1225(b)(1) are similar to those recently addressed by this Court in Rincon v. Hyde, No. 25-12633-BEM, 2025 WL 3122784 (D. Mass. Nov. 7, 2025) and Tenemasa-Lema v. Hyde, No. 25-13029-BEM, 2025 WL 3280555 (D. Mass. Nov. 25, 2025).” Dkt. 6 at 1. But Respondents do not provide documentation supporting detention under 8 U.S.C. § 1225(b)(1). Instead, the provided documents indicate petitioner is subject to detention under 8 U.S.C. § 1226(a). See e.g., Dkt. 6-1 at 1 (Warrant for Arrest of Alien pursuant to section 1226). Accordingly, Respondents shall release Petitioner by 5:00 pm on Thursday, July 2, 2026, unless, before that time, Petitioner is provided a bond hearing under 8 U.S.C. § 1226(a). Respondents are additionally ordered to file a status report by 1:00 pm on July 6, 2026.
