ORDER denying 1 Petition for Writ of Habeas Corpus. The facts alleged do not rise to a due process violation because Petitioner has only been detained for four months, and he doesnt argue that the individualized bond hearing he received as required by 8 U.S.C. § 1226(a) was fundamentally unfair. See Zadvydas v. Davis, 533 U.S. 678, 680 (2001). His Fourth Amendment claim fails because the circumstances of Mr. Delgado's arrest dont bear on his immigration proceedings his identity isn't suppressible. I.N.S. v. Lopez-Mendoza, 468 U.S. 1032, 103940. And because Petitioner's appeal is pending, Section 1231 doesnt apply. 8 U.S.C. § 1231(a)(1). Signed by Judge J. Nicholas Ranjan on 7/30/2026.
