ORDER GRANTING 11 Motion for leave to File Amended Petition. In the 11 Motion, Petitioner SHAKER SOLIMAN requests leave to file a first amended petition for writ of habeas corpus. Petitioner's proposed amendments reflect recent developments in Petitioner's removal proceedings; specifically, the immigration court's recent grant of Petitioner's motion for voluntary departure. ECF No. 11 para. 3. Respondents consent to Petitioner's request for leave to amend. Id. para. 10. Per Federal Rule of Civil Procedure 15(a)(2), a party may amend its pleadings with the opposing party's written consent or the court's leave. Rule 15(a)(2) provides that "the court should freely grant leave when justice so requires." Given the material developments in Petitioner's removal proceedings that have occurred since Petitioner filed the 3 Petition, and given Respondent's consent to the 11 Motion, the Court find that justice requires granting leave to amend. ORDER GRANTING 17 Motion to Dismiss 13 Amended Petition as MOOT. On 9/14/2026, Petitioner filed a 17 Motion to Dismiss the 13 Amended Petition as moot, averring that he was removed to Egypt on September 11, 2026, thereby "eliminat[ing] the live controversy concerning Petitioner's continued physical confinement." The Court agrees that Petitioner's removal from the United States moots the 13 Amended Petition. See Moreno Colindre v. Oddo et al, No. 3:26-cv-176, ECF No. 9 (W.D. Pa. Mar. 13, 2026) (Wiegand, J.).
