MINUTE ORDER IN CHAMBERS of the Honorable Judge Richard F. Boulware, II on 7/6/2026.IT IS HEREBY ORDERED Petitioner's 7 Motion/Application for Leave to Proceed in forma pauperis is GRANTED.The Court has reviewed Petitioner's 8 First Amended Petition for Writ of Habeas Corpus and preliminarily finds Petitioner can likely establish that his circumstances warrant the same relief as this Court granted to similarly situated habeas petitioners in Reyes Campos v. Mattos, No. 2:26-CV-00850-RFB-BNW, 2026 WL 1362541 (D. Nev. May 15, 2026) and Rodriguez Cabrera v. Mattos, 808 F. Supp. 3d 1159 (D. Nev. 2025).Therefore, Respondents are HEREBY ORDERED to SHOW CAUSE why the 8 Amended Petition should not be granted. See 28 U.S.C. § 2243. Specifically, Respondents must file a notice of appearance and a "return certifying the true cause of [Petitioner Vasquez Alvarado's] detention" by July 9, 2026. See id. Petitioner shall file a traverse by July 13, 2026. IT IS FURTHER ORDERED that Federal Respondents shall answer the following interrogatories under oath in their Return: (1) was Petitioner's June 2026 arrest pursuant to an administrative warrant or otherwise permitted under 8 U.S.C. § 1357; (2) was an initial custody determination conducted as to Petitioner under 8 C.F.R. § 236.1(c)(8) upon his re-detention in June 2026. See Rule 7, Rules Governing Section 2254 Cases in the United States District Courts; id., Rule 1(b) (enabling a court to apply these rules to petitions brought under 28 U.S.C. §2241). Federal Respondents shall file any 2026 administrative warrant and/or 2026 Form I-286 Notice of Custody Determination with their Return or certify that no such documents are in their possession, custody, or control.IT IS FURTHER ORDERED that Federal Respondents shall file all records relating to Petitioner's August 2023 release on personal recognizance in their possession, custody, or control, including but not limited to any Form I220A, with their Return. IT IS FURTHER ORDERED that this Court's prior 3 Orders regarding briefing, filing, scheduling, document production, and removal remain in full effect.Show Cause Response ("Return") is due by 7/9/2026.
