Judge Brian E. Murphy: ELECTRONIC ORDER entered DENYING 1 petition for writ of habeas corpus. Petitioner appears to be subject to mandatory detention under 8 U.S.C. s. 1226(c) (“section 1226(c)”). See Dkt 10 at 1; see also Dkt 10 -1 (criminal record); Dkt. 10 -2 (decision denying motion to terminate because Petitioner has convicted of a crime that renders him removable under 8 U.S.C. 1227(a)(2)(A)(i)); Dkt. 9 -3 at 1 (Warrant for Arrest of Alien pursuant to 8 U.S.C. s. 1226). Petitioner argues that the prolonged duration of his detention—nearly nineteen months as of the date of this order, see Dkt. 9 -3 at 2—runs afoul of his due process rights, Dkt. 1 at 6, see also Dkt. 2 at 7. The First Circuit has not yet opined on the proper test to evaluate claims by noncitizens detained under section 1226(c) challenging the duration of their detention. See Lino-Ramos v. Moniz, 2026 WL 1759415, at *5 (D. Mass. June 18, 2026). However, here, where Petitioner has an order of removal that will imminently become final—once the window to appeal expires, or any appeal is heard, a bond hearing is not warranted under either candidate test. Id. at *7–8, 10 (considering, inter alia, both the foreseeability of proceedings concluding and the value of additional procedural safeguards (citing first Reid v. Donelan, 390 F. Supp. 3d 201, 219 (D. Mass. 2019), then Mathews v. Eldridge, 424 U.S. 319 (1976)). Accordingly, the petition is DENIED.(MAC) (Entered: 07/22/2026)
