District Judge Angel Kelley: ELECTRONIC ORDER entered. Before the Court is Petitioner Alexander Gramajo Morales’ Petition for Writ of Habeas Corpus. [Dkt. 1]. Respondents submit that “Petitioner is eligible for a bond hearing under 8 U.S.C. § 1226(a)” and that they “do not object to the Court’s ordering a bond hearing.” [Dkt. 9 at 1]. Accordingly, Petitioner’s Petition [Dkt. 1] is GRANTED. Respondents are ORDERED to provide Petitioner with a bond hearing under 8 U.S.C. § 1226(a) within 10 calendar days of this Order. Respondents are ENJOINED from denying Petitioner bond on the basis that he is detained pursuant to 8 U.S.C. § 1225(b)(2). The parties are ORDERED to file a status report within 14 calendar days of this Order stating whether Petitioner has been granted bond, and, if his request for bond was denied, the reasons for that denial. District Judge Angel Kelley: ELECTRONIC ORDER entered. On June 25, 2026, this Court granted Petitioner’s Petition for Writ of Habeas Corpus. [Dkt. 10]. On July 6, 2026, Petitioner filed a Status Report indicating that he had not yet received a bond hearing, despite the Court’s Order to provide one within 10 days. [Dkt. 11]. On these grounds, Petitioner filed a Motion for Release on July 8, 2026. [Dkt. 12]. On July 9, 2026, Respondents filed a Status Report indicating that Petitioner’s bond hearing had initially been scheduled for July 6, 2026, but was rescheduled by one day to July 7, 2026. [Dkt. 13]. However, Petitioner withdrew his request for the bond hearing. [Dkt. 14]. Petitioner’s counsel submits that this withdrawal was “in anticipation of this Court ordering Petitioner’s immediate release” because of the one-day delay. [Dkt. 15-1 ¶ 11].In light of the delay of one day, and in the absence of any allegation of bad faith, the Court declines to find that Respondents intentionally violated the Court’s prior Order. Thus, the Court finds that the appropriate remedy is a new bond hearing rather than immediate release. Accordingly, Petitioner’s [Dkt. 12 ] Motion for Release is DENIED. Respondents are hereby ORDERED to provide Petitioner with a bond hearing under 8 U.S.C. § 1226(a) within 10 calendar days of this Order. Respondents are ENJOINED from denying Petitioner bond on the basis that he is detained pursuant to 8 U.S.C. § 1225(b)(2).
