TEXT ORDER re Respondents' # 4 Status Report and Petitioners # 5 Status Report. On June 17, 2026, the Court enjoined Respondents from moving Petitioner outside the jurisdiction of the Northern District of New York until this civil action is resolved. Dkt. No. 2 . Respondents request that the order be modified to restrict Petitioner's transfer from the Northern or Western Districts of New York (DKT # 4 ). Respondents note that they don't have any opposition to amending the Courts Order to permit movement to WDNY (DKT # 5 ). Petitioner's transfer to the Western District of New York will not deprive the Court of jurisdiction over this action, see Rumsfeld v. Padilla, 542 U.S. 426, 441 (2004) (acknowledging that a district court retains habeas jurisdiction notwithstanding a subsequent transfer of the petitioner). Accordingly, Respondents' request for modification is GRANTED. It is ORDERED that Respondents are enjoined from transferring Petitioner outside of the Northern or Western Districts of New York until this civil action is resolved. TEXT ORDER: On June 17, 2026, petitioner, acting through counsel, filed this emergency petition for a writ of habeas corpus under 28 U.S.C. § 2241 challenging his detention by immigration authorities. Dkt. No. 1 . Among other things, the petition alleged that, upon information and belief, he was arrested without a warrant and was not given a meaningful opportunity to contest his detention, such as by seeking release on bond. Id. 9-10, 12. After this Court directed expedited briefing on the petition, Dkt. No. 2, the Government responded by representing that an administrative warrant was issued for petitioner's arrest, that petitioner was arrested pursuant to that warrant, that petitioner was offered a bond hearing, that he received one, and that bond was set at $5,000, Dkt. No. 7 . In reply, petitioner contends that his re-detention was arbitrary and, because the Government continues to incorrectly assert that it has authority to re-detain noncitizens who are "similarly situated" under 8 U.S.C. § 1225, that relief is warranted in the form of his immediate release. Dkt. No. 8 . Upon review, petitioner is ORDERED to file a supplemental brief explaining (1) whether he is disputing any of the Government's factual representations made with respect to his detention in this habeas proceeding; and (2) the legal significance, if any, of these factual representations to the relief that he has requested. Petitioner is reminded that, regardless of whether the Government continues to erroneously argue that § 1225 authorizes re-detention of other noncitizens, the question is whether petitioner's constitutional rights were violated by the conduct of government officials in this case.
