TEXT ORDER: Petitioner Eduardo Calderon-Ocoix contends that he was unlawfully taken into immigration custody on June 13, 2026, and is unlawfully detained in Delaney Hall Detention Facility under 8 U.S.C. § 1225(b). (ECF No. 1, Petition at 5, 7-8.) In support of his request for release, Petitioner alleges he is not a flight risk or danger to the community. (Id. at 8.) On June 17, 2026, Respondents advised the Court that Petitioner appears to have been transferred outside the Court's jurisdiction that day, and Respondents would investigate and provide a status report on Petitioner's location, and the effect of his transfer on the Court's jurisdiction. (ECF No. 3, June 17, 2026 Letter.) Respondents have not done so. IT IS ORDERED that, within 24 hours, Respondents shall file a status report on Petitioner's location and the facts concerning the timing and location of his transfer outside this district. If Respondents do not contest this Court's jurisdiction, they shall file an expedited answer to the Petition with their status report. So Ordered by Judge Katharine S. Hayden on 7/20/26. TEXT ORDER: Respondents filed an answer to the Petition asserting that ICE transferred Petitioner to Alexandria, Louisiana before the Petition was filed, and Petitioner is currently detained in Adams County Correctional Center in Mississippi. (ECF No. 8, Answer at 1.) Respondents also submit that they rely on the same arguments made in prior cases in this district involving statutory interpretation of 8 U.S.C. § 1225(b)(2) and 8 U.S.C. § 1226(a), and this Petition asserts facts similar to those prior cases, which held the petitioners were subject to discretionary detention under § 1226(a). See, e.g., Rivera Zumba v. Bondi, Civ. No. 25-cv-14626, 2025 WL 2753496, at *7-9 (D.N.J. Sept. 26, 2025) (holding the plain language of 8 U.S.C. § 1225(b)(2)(A) does not govern the detention of a noncitizen who enters the United States without inspection and is later arrested within the interior of the United States).IT IS ORDERED that, within 48 hours of this Order, if Respondents contest this Court's jurisdiction, Respondents shall either (1) file documents and/or affidavits establishing Petitioner's transfer outside this district prior to filing of the Petition or (2) Respondents shall release Petitioner within 48 hours, based on the allegations in the Petition and this Court's prior decisions. Prior to Petitioner's release, attorneys for the parties shall meet and confer regarding the logistics of Petitioner's release.
