If Respondent has custody of Petitioner's documents (e.g., identification, passport, work permit, Social Security card, etc.), Respondent shall return those to Petitioner at the time of release; Respondent be enjoined and restrained from re-detaining Petitioner unless the government demonstrates, by clear and convincing evidence at a pre-deprivation bond hearing before a neutral decisionmaker, that Petitioner is a flight risk or danger to the community such that his physical custody is legally justified. ORDER signed by District Judge Dena M. Coggins on 8/15/2026 ADOPTING IN PART 7 The Findings and Recommendations. Petitioner Jesus Brayan Cortez Ledezma's (A-249-008-056) petition for a writ of habeas corpus 1 is GRANTED, as follows: Within fourteen (14) days, Respondents are ORDERED to provide Petitioner a bond hearing before an immigration judge at which the government shall bear the burden of proving, by clear and convincing evidence, that Petitioner is either a flight risk or risk to community safety such that Petitioner's continued immigration detention is justified; and If Respondents fail to provide Petitioner a bond hearing within fourteen (14) days, Petitioner shall be immediately released from Respondents' custody on the same terms as Petitioner's previous release; Within fifteen (15) days of the date of entry of this order, Respondents are ORDERED to file a status report with the court confirming compliance with this order; The Clerk of the Court is directed to serve the California City Detention Facility with a copy of this order; and The Clerk of the Court is directed to enter judgment in favor of Petitioner and close this case.
