MINUTE ORDER issued by Courtroom Deputy for Chief District Judge Troy L. Nunley on June 17, 2026: The Court has reviewed Petitioner's Petition for Writ of Habeas Corpus and Motion for Temporary Restraining Order ("TRO"). (ECF Nos. 1, 2 .) Due to the urgent nature of the requested relief, the Court intends to rule directly on the Habeas Petition with the understanding that the Court will also consider arguments made in support of the Motion for TRO. Respondent shall file a response to the Habeas Petition by June 22, 2026. Any opposition must include Petitioner's full Form I-213, any orders of release or detention, any custody warrants or notices, and any other documents and portions of Petitioner's A-File relevant to the issues presented. Failure to timely respond will be construed as a non-opposition. See L.R. 230(c). The matter is not set for hearing at this time. Pending the Court's ruling on the Habeas Petition, Respondent shall not transfer Petitioner out of this District. See F.T.C. v. Dean Foods Co., 384 U.S. 597, 608 (1966) (noting the court's "express authority under the All Writs Act to issue such temporary injunctions as may be necessary to protect its own jurisdiction."). MINUTE ORDER issued by Courtroom Deputy for Chief District Judge Troy L. Nunley on June 26, 2026: This matter is before the Court on Petitioner's Petition for Writ of Habeas Corpus and Motion for Temporary Restraining Order. (ECF Nos. 1, 2 .) Respondent filed a response. (ECF No. 9 .) As set forth in the Court's upcoming Order, the Habeas Petition is GRANTED. (ECF No. 1 .) Petitioner's Motion for TRO is DENIED as moot. (ECF No. 2 .) Respondent is ORDERED to IMMEDIATELY RELEASE Petitioner Alieskys V.S. (A # 246-209-501) from custody under the same conditions he was released under prior to his current detention. At the time of release, Respondent must return all of Petitioner's documents and possessions. Respondent is ENJOINED and RESTRAINED from re-arresting or re-detaining Petitioner absent compliance with constitutional protections, including seven-days' notice and a pre-deprivation hearing.
