MINUTE ORDER issued by Courtroom Deputy for District Judge Daniel J. Calabretta on 6/25/2026: On June 15, 2026, Petitioner filed a Petition for Writ of Habeas Corpus. (ECF No. 1 .) Based on the information in the Petition, the Court determined that it appeared Petitioner was entitled to relief and ordered a return pursuant to 8 U.S.C. § 2243. (ECF No. 6 .) Based on the information in the return, it is no longer clear that Petitioner is entitled to relief as required by 8 U.S.C. § 2243, as he may be subject to mandatory detention under 8 U.S.C. § 1226(c). (See ECF No. 7 .) However, the Court believes this case would benefit from the appointment of counsel. Within seven (7) days from the date of this order, the appointing authority for the Eastern District of California shall identify counsel and send counsel's contact information gmichel@caed.uscourts.gov, who shall update the docket to reflect counsel's appointment. If counsel is not a member of the Eastern District of California Criminal Justice Act Panel, within seven (7) days of this Order the Federal Defender shall file a motion to appoint counsel as CJA counsel pro hac vice. This matter is referred to the assigned Magistrate Judge for full briefing. The Clerk's Office is directed to serve a copy of the petition on the Federal Defender. ORDER AND FINDINGS and RECOMMENDATIONS signed by Magistrate Judge Sean C. Riordan on 8/3/2026 GRANTING Petitioner's 2 motion to proceed ifp and DENYING Petitioner's 3 motion to appoint counsel as moot. IT IS RECOMMENDED Petitioner's 1 application for a writ of habeas corpus be granted, Respondent be ordered to immediately release Petitioner Reynaldo Eric Abdala Belisario (A#200-010-372), based on the same conditions he was subject to immediately prior to his detention on 4/29/2026, Respondent shall not impose any additional restrictions on him unless they are determined to be necessary at a future pre-deprivation/custody hearing, At the time of release, Respondent be ordered to return Petitioner's documents and possessions, If the government seeks to re-detain Petitioner, it must provide no less than seven (7) days' notice to Petitioner and must hold a pre-deprivation bond hearing before a neutral arbiter, at which it must show by clear and convincing evidence that a material change in circumstances renders Petitioner either a danger to the community or a risk of flight, The order entered in this case not address the circumstances in which Respondent may detain Petitioner in the event Petitioner becomes subject to an executable final order of removal and Petitioner receives notice of that final order of removal, and the Clerk of Court be directed to: a. Serve the California City Detention Facility with a copy of any order of release issued in this case; and, b. Enter judgment for Petitioner and close this case. Referred to Judge Daniel J.
