REPORT AND RECOMMENDATION re 1 Petition for Writ of Habeas Corpus filed by Rosa Isela De La Cruz Martinez. The undersigned recommends the Court grant Petitioner's habeas petition in part and order Respondents to provide Petitioner with an i ndividualized bond hearing before a neutral Immigration Judge within seven days or else release Petitioner. The undersigned also recommends that the Court order Respondents to certify their compliance with the Court's order by filing a status re port within ten business days of the Court's order and promptly providing a copy of this order to counsel for the Warden of the Diamondback Correctional Facility and the Logan County Jail in Guthrie, Oklahoma. ORDER ADOPTING REPORT AND RECOMMENDATION ~ The Court STRIKES Respondents' objection to the Report and Recommendation 9 . The Report and Recommendation 8 is ADOPTED and Petitioner's Petition for Writ of H abeas Corpus under 28 U.S.C. § 2241 is GRANTED IN PART in so far as it alleges Respondents violated the Immigration and Nationality Act. The Court ORDERS Respondents to provide Petitioner with a bond hearing pursuant to 8 U.S.C. § 1226 (a) within seven days of the date of this Order, or otherwise release Petitioner if she has not received the hearing within that period.
