MINUTE ORDER (Text Entry Only) This is the second habeas case filed by this Petitioner. In his first case, Petitioner indicated he was re-detained on December 11, 2025. Gebremariam v. Chestnut, 1:26-cv-00293-WBS-JDP, Docket No. 1. That case was closed on May 19, 2026, after the Court denied his petition. Petitioner initiated this second case on June 12, 2026, (Doc. 1 ), the magistrate judge issued a scheduling order on June 18, 2026, (Doc. 6 ), and Respondents filed their response on June 30, 2026. (Doc. 9 .) On August 17, 2026, Petitioner filed a request for an update and a motion for a temporary restraining order. (Docs. 11, 12 .) Though the Court understands Petitioner's desire to have his case adjudicated as promptly as possible, the currently challenged detention dates to December 11, 2025, more than 8 months ago. Petitioner does not explain his delay in seeking his request for a temporary restraining order or why despite this delay, the Court should treat the situation as a procedural emergency. Thus, the TRO request is untimely, and it is DENIED. Local Rule 231(b). The Court endeavors to address all habeas petitions as expeditiously as possible and will do so in this case signed by District Judge Jennifer L. Thurston on August 18, 2026.
