TEXT ORDER: Petitioner is a citizen of Burkina Faso who entered the United States in 2022 on a B1 Visa and overstayed; he has no criminal history and was arrested pursuant to a warrant on April 14, 2026. (ECF No. 1, Petition at 36-39.) He is detained pursuant to 8 U.S.C. § 1226(a) and alleges in his Petition that he did not receive an adequate individualized bond hearing before the Immigration Court. This Court may only review whether the bond hearing was fundamentally unfair, see Ghanem v. Warden Essex Cnty. Corr. Facility, No. 21-1908, 2022 WL 574624, at *2 (3d Cir. Feb. 25, 2022), and lacks jurisdiction to review discretionary determinations underlying the immigration judge's bond decision. See 8 U.S.C. § 1226(e). Therefore, the Petition is not a substitute for an appeal of the immigration judge's Order denying bond. Petitioner has provided a transcript of the bond hearing. (ECF No. 3 .) Respondents are ORDERED to file a response to the Petition within 7 days. Petitioner may file a reply brief within 7 days of the filing of the response.
