See Fed. R. Civ. P. 42(a)(2); In re Adams Apple, Inc., 829 F.2d 1484, 1487 (9th Cir. 1987) (court may consolidate actions sua sponte). Accordingly, it is HEREBY ORDERED that: (1) this action (Comas v. Warden, et al., Case No. 1:26-cv-04387-KES-CDB) and the later-filed action (Comas v. Warden, Case No. 1:26-cv-05782-KES-CDB) are CONSOLIDATED FOR ALL PURPOSES; (2) The case identified as Comas v. Warden, et al., Case No. 1:26-cv-04387-KES-CDB, will be designated the Lead Case, and all further records and documents filed in this consolidated action shall be filed within the Lead Case (1:26-cv-04387-KES-CDB); (3) appointed counsel for Petitioner (Doc. 9 ) is DIRECTED to file a notice of appearance on behalf of Petitioner in the Lead Case; (4) Petitioner shall have ten days to file any supplemental briefing in opposition to Respondent's pending motion to dismiss in the Lead Case; and (5) the Clerk of the Court is directed to close the member case, Comas v.
