ORDER: Petitioner's amended petition for writ of habeas corpus 16 is GRANTED to the extent it seeks a bond hearing. Respondents must provide petitioner a bond hearing within seven days of this order being docketed at which they must justify petitioners continued detention by a showing of clear and convincing evidence that he is a flight risk and a danger to the community, or release him from custody under the same conditions that existed before petitioner's detention. If the immigration judge declines to release petitioner on bond, her decision must identify the clear and convincing evidence that justifies petitioner's continued detention. Respondents must provide a notice of compliance within three days of releasing petitioner or providing petitioner a bond hearing, including the outcome of the bond hearing. ORDER - IT IS ORDERED Respondents shall file a response to the Motion to Enforce Judgment (Doc. 25 ) no later than 5:00 p.m. on October 2, 2026. Petitioner shall file a reply no later than 9:00 a.m. on October 5, 2026. Respondents should address this court's authority to mandate particular appearance protocols at immigration hearings, including whether telephonic appearances are generally permitted before this immigration judge.
