TEXT ORDER - This matter comes before the Court upon Petitioner's application for a Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241, challenging his continued detention under 8 U.S.C. § 1226(a) at the Elizabeth Detention Center. (ECF No. 1.) According to the Petition, Petitioner has been detained since November 13, 2025, following a prior bond determination. Petitioner alleges his removal proceedings remain pending on appeal before the Board of Immigration Appeals, with briefing scheduled to conclude on June 16, 2026. Petitioner further alleges that he suffers from significant and worsening medical conditions, including recurrent chest pain in the context of a prior heart attack, as well as a painful tumor in his right arm that allegedly restricts mobility and for which he contends he is unable to obtain surgical treatment while detained. (Id.) Accordingly, it is ORDERED that Respondents shall SHOW CAUSE, within seven (7) days of the date of this Order, as to why the relief requested in the Petition should not be granted. Respondents shall specifically address: (1) the basis for Petitioner's continued detention under 8 U.S.C. § 1226(a) in light of the length of custody, the pending BIA appeal, and the anticipated timing of further administrative proceedings; (2) Petitioner's allegations of serious medical conditions, including chest pain in the context of a prior heart attack and a tumor in his right arm allegedly requiring surgical intervention, and whether appropriate evaluation, monitoring, and treatment are being provided in custody. Petitioner may file a reply within three (3) business days after Respondents file their response. Petitioner shall serve a copy of the Petition and this Order upon Respondents within two (2) business days of entry of this Order and shall promptly file proof of service on the docket.
