MINUTE ORDER signed by Magistrate Judge Jeremy D. Peterson on 7/9/2026: Petitioner has filed what the court construes as a request to voluntarily dismiss this case without prejudice. (ECF No. 13 .) Since respondent has filed an opposition to the petition, petitioner may not unilaterally dismiss this case pursuant to Federal Rule of Civil Procedure 41(a)(1)(A)(i). Rather, petitioner can only dismiss this action by filing "a stipulation of dismissal signed by all parties who have appeared." See Fed. R. Civ. P. 41(a)(1)(A)(ii). Respondent may stipulate to dismissal of this action pursuant to Rule 41(a)(1)(A)(ii). Even if respondent declines to stipulate, the court may dismiss this action based upon petitioner's request "on terms that the court considers proper." See Fed. R. Civ. P. 41(a)(2). Accordingly, it is hereby ORDERED that respondent shall file by 7/16/2026 either a document stipulating to dismissal of this action without prejudice pursuant to Rule 41(a)(1)(A)(ii), or a response to petitioner's request for voluntary dismissal. (Text Only Entry). (Deputy Clerk NAC) (Entered: 07/09/2026)
